Auto Data Direct pointed out that tow, storage and recovery businesses in Florida should now be encountering changes in requirements for the good faith letter process and certificate of destruction procedures based on a new law passed by the Florida Legislature.

As a result, ADD is offering what it believes is an affordable and effective solution to these industries for complying with the new law.

Because of a new law that went into effect on Monday, Florida's good faith procedure for locating out-of-state owners or lienholders as part of the towed vehicle notification process includes a record check through the National Motor Vehicle Title Information System (NMVTIS) to determine the current state of title.

ADD explained this process will not only save the towing industry and law enforcement significant costs, it will also expedite the notification of out-of-state owners and lien holders of vehicles towed in the state of Florida. 

The same legislation also requires tow, storage, and recovery businesses to report information about the vehicles they handle to NMVTIS.  Licensed salvage motor vehicle dealers are required to report the purchase of “derelict” vehicles to NMVTIS. 

ADD also pointed out that tow operators must report vehicles to NMVTIS prior to applying for a Certificate of Destruction with the Florida DHSMV and all applications for a certificate of destruction in Florida must now include proof of reporting to NMVTIS.

Officials believe this consumer protection measure ensures that vehicle histories obtained through the national database alert prospective purchasers to salvage brands placed on the vehicle.
